Marshfield, WI (OnFocus) The Board of Education for the School District of Marshfield has called a special meeting for Jan. 2 at 5 p.m. to hold student expulsion hearings.
Under Wisconsin State Statute 120.13, the school board may expel a pupil for conveying false information of an attempt or alleged attempt to destroy school property by means of explosives, or acted in a way which endangered the property, health, and safety of others, or threatened to do so.
The statute also allows expulsion if a pupil repeatedly disrupted the educational atmosphere at school or the ability of school authorities to maintain order.
A hearing is required prior to expulsion. If expelled, a pupil or the pupil’s parents or guardian can appeal the decision to the state superintendent, who within 60 days of receiving the appeal will review it and make a decision to approve, reverse, or modify the decision. However, the board’s decision is enforced during this period.
The state superintendent reviews the expulsion hearing record to ensure procedures have been followed, but does not review whether the board was right to expel the student for the conduct in question, whether the length of expulsion is harsh, or if evidence for expulsion outweighed evidence on behalf of the student, according to the Wisconsin Department of Public Instruction.
Within 30 days, the state superintendent’s decision can be appealed to circuit court.
