Under the proposed law, developers would need to secure approval from each city, village, or town where their projects are planned before seeking final authorization from the Wisconsin Public Service Commission (PSC). This would mark a significant shift from the current process, where the PSC has the primary authority over these decisions.
Key Provisions of the Bill:
- Local Approval Requirement: Municipalities would have 90 days to approve or disapprove proposed projects after receiving a request. The deadline could be extended if needed.
- Automatic Advancement: If a municipality does not make a decision within the allotted timeframe, the project would automatically move forward for PSC consideration.
- Enhanced Local Control: The bill aims to empower municipalities to retain significant authority over project approval decisions, even in areas where state regulations currently limit local control.
Sen. Marklein and Rep. Tranel emphasize that the legislation is designed to give local communities a stronger voice in decisions that directly affect them. In their co-sponsorship memo, they noted that residents and local officials in rural areas often feel overlooked when raising concerns about large utility projects.
